TERMS AND CONDITIONS

Effective Date: September 30, 2026

These Terms & Conditions ("Terms") govern your access to and use of robalagency.com, including any webpages, forms, content, media, materials, features, or services made available through the website (collectively, the "Website").

The Website is owned and operated by Camera Gilson LLC, doing business as Robal Agency ("Robal Agency," "Robal," "we," "us," or "our").

By accessing, browsing, or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Website.

1. About Robal Agency

Robal Agency is a creative production and strategic services agency providing services that may include photography, video production, event content, campaign production, creative strategy, production management, post-production, and related services.

Information presented on the Website is provided for general informational, promotional, and business development purposes only.

Nothing on the Website constitutes an offer, guarantee, binding commitment, or agreement to provide any particular service.

2. Website Terms Are Separate From Client Agreements

These Terms govern use of the Website only.

Any professional services provided by Robal Agency are governed by a separate written agreement, proposal, statement of work, production agreement, estimate, order, or other written document accepted by Robal Agency and the applicable client.

Submitting an inquiry, requesting an estimate, scheduling a consultation, exchanging emails, participating in a call, receiving a proposal, or otherwise discussing a potential project does not, by itself, create a binding engagement or require Robal Agency to perform services.

No project is considered confirmed unless all applicable requirements specified by Robal Agency have been satisfied, which may include execution of an agreement and receipt of a required deposit or retainer.

If there is any conflict between these Terms and a separately executed client agreement, the executed client agreement will control with respect to the applicable engagement.

3. Estimates, Proposals, Budgets, and Availability

Any pricing, estimates, budgets, schedules, timelines, deliverables, staffing recommendations, production plans, or other project information communicated through the Website or during preliminary discussions are subject to change unless incorporated into a written agreement accepted by Robal Agency.

Availability is not guaranteed until a project is formally confirmed.

Robal Agency reserves the right to accept or decline any inquiry, project, client, engagement, or request at its discretion.

Unless otherwise expressly stated in writing, proposals and estimates may expire or be revised based on changes in scope, availability, timing, production requirements, vendor costs, location requirements, insurance requirements, travel, staffing, licensing, or other project circumstances.

4. Permitted Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms.

You may not:

  • copy, reproduce, republish, distribute, sell, license, or commercially exploit Website content without prior written authorization;

  • download, reproduce, distribute, or reuse photographs, videos, case studies, graphics, designs, copy, treatments, presentations, concepts, or other creative materials except for ordinary viewing;

  • falsely represent Robal Agency's work as your own;

  • remove copyright notices, trademarks, watermarks, credits, ownership notices, or other identifying information;

  • use Robal Agency's name, work, content, or branding in a misleading or unauthorized manner;

  • gain or attempt to gain unauthorized access to the Website, servers, systems, databases, accounts, or infrastructure;

  • interfere with or disrupt the operation or security of the Website;

  • introduce viruses, malware, malicious code, automated attacks, or other harmful technology;

  • scrape, crawl, harvest, extract, index, or collect Website content through automated means without prior written authorization;

  • use bots, scripts, automated tools, artificial agents, or similar technologies to access or extract Website content in a manner not expressly authorized;

  • use Website content, photographs, videos, copy, creative work, concepts, or other materials to train, develop, fine-tune, test, evaluate, or operate artificial intelligence or machine learning systems without prior written authorization;

  • impersonate Robal Agency or any employee, representative, contractor, client, partner, or affiliate of Robal Agency;

  • attempt to obtain information not intentionally made available through the Website; or

  • use the Website in a manner that violates applicable law or infringes the rights of another person or entity.

5. Intellectual Property

Unless otherwise stated, the Website and its contents, including its design, layout, text, branding, logos, photographs, videos, graphics, animations, case studies, presentations, concepts, creative materials, production materials, and other content, are owned by Robal Agency, licensed to Robal Agency, or displayed with authorization from the applicable rights holder.

The Website and its contents are protected by copyright, trademark, trade dress, and other applicable intellectual property laws.

Nothing in these Terms transfers ownership of any intellectual property to you.

You are granted only a limited, personal, revocable, non-exclusive, and non-transferable right to access and view the Website for lawful informational and business evaluation purposes.

No other license or right is granted, whether by implication, estoppel, or otherwise.

6. Portfolio and Client Work

The Website may display work created for clients, agencies, brands, venues, public figures, talent, organizations, partners, or other third parties.

The appearance of third-party names, trademarks, logos, individuals, locations, products, services, or other materials does not necessarily indicate sponsorship, endorsement, affiliation, partnership, or ongoing business relationships unless expressly stated.

Certain portfolio materials may contain intellectual property, likenesses, trademarks, or other materials owned by third parties.

Those materials remain subject to the rights of their respective owners.

You may not copy, reproduce, distribute, publish, license, modify, commercially exploit, or otherwise use portfolio materials displayed on the Website without all required permissions.

7. Robal Agency Name, Trademarks, and Branding

The names Robal Agency, Robal, associated logos, branding, slogans, trade dress, graphic elements, and other identifying materials may be protected by trademark, copyright, or other applicable laws.

You may not use Robal Agency's name, logo, branding, or other identifying materials in a manner that suggests sponsorship, endorsement, partnership, affiliation, employment, or authorization without prior written permission.

8. Portfolio Results and No Guarantee of Outcomes

Portfolio work, case studies, testimonials, project descriptions, client examples, creative examples, and other content displayed on the Website are provided for illustrative purposes only.

Past projects do not guarantee similar creative, commercial, financial, marketing, publicity, engagement, conversion, audience, revenue, or business results for any future project.

Results may vary based on factors including strategy, scope, creative direction, timing, media spend, distribution, audience, market conditions, client participation, venue conditions, talent, production circumstances, and other factors outside Robal Agency's control.

9. Materials Submitted to Robal Agency

If you voluntarily submit information or materials to Robal Agency through the Website, including project descriptions, briefs, references, schedules, budgets, contact information, documents, images, presentations, or other materials, you represent that you have the authority and necessary rights to provide those materials.

You retain ownership of materials you submit.

You grant Robal Agency permission to review, internally reproduce, store, and share those materials with its employees, contractors, advisors, vendors, or potential production partners as reasonably necessary to evaluate, respond to, prepare for, or perform a potential engagement.

Unless Robal Agency has expressly agreed otherwise in a separate written confidentiality agreement, information submitted through the Website will not create a confidential, fiduciary, exclusive, or privileged relationship.

You should not submit trade secrets, highly confidential information, proprietary materials, or sensitive information through the Website unless appropriate confidentiality arrangements have first been established.

10. Unsolicited Creative Submissions

Robal Agency does not accept unsolicited creative concepts, treatments, campaign ideas, scripts, production concepts, advertising ideas, creative strategies, pitches, storyboards, or other proprietary creative materials unless specifically requested.

Any unsolicited materials submitted without a separate written confidentiality agreement will not be treated as confidential.

Robal Agency will have no obligation to review, use, compensate for, acknowledge, or return unsolicited materials.

You acknowledge that Robal Agency may independently develop, receive, produce, or work on concepts, ideas, strategies, formats, campaigns, or creative work that are similar or identical to materials submitted by you.

The submission of materials does not create any obligation, exclusivity, partnership, agency, fiduciary relationship, or right to compensation.

11. No Exclusivity

Use of the Website, submission of an inquiry, participation in preliminary discussions, or receipt of a proposal does not create an exclusive relationship.

Robal Agency may provide services to other businesses, organizations, individuals, agencies, or brands, including those operating within the same or similar industries.

Robal Agency may also independently develop concepts, production approaches, strategies, formats, creative ideas, or deliverables that may be similar to those discussed with prospective or existing clients, subject to any separate confidentiality or contractual obligations Robal Agency has expressly accepted in writing.

12. Communications and Business Inquiries

If you submit an inquiry, schedule a consultation, or otherwise provide contact information to Robal Agency, you authorize Robal Agency to contact you regarding your inquiry, potential services, project opportunities, proposals, scheduling, or related business matters.

Submitting an inquiry does not guarantee a response, availability, pricing, acceptance of a project, or provision of services.

Robal Agency is not responsible for missed communications caused by spam filters, technical problems, incorrect contact information, third-party services, or other circumstances outside its reasonable control.

13. Electronic Communications

When you communicate with Robal Agency electronically, including through email, forms, scheduling platforms, or other digital systems, you consent to receive communications electronically.

You agree that electronic communications may satisfy legal requirements that communications be in writing, except where applicable law or a separately executed agreement requires another method.
